In these terms and conditions, the following definitions apply:
These terms and conditions apply to all agreements between the Service Provider and the User regarding the use of the Service.

3.1. pitit - Email Marketing provides an email campaign management platform that allows Users to manage email campaigns using their own Amazon Simple Email Service (SES) backend.
3.2. The Service includes features for creating campaigns, managing subscriber lists, tracking email performance, and related email marketing functionalities.
3.3. The Service Provider reserves the right to modify, suspend, or discontinue any aspect of the Service at any time.
4.1. To use the Service, the User must create an account.
4.2. The User is responsible for keeping login credentials confidential.
4.3. The User guarantees that the information provided is accurate and complete.
4.4. Only one account per organization is allowed, unless otherwise agreed.
4.5. The User must be at least 18 years old or have parental consent to use the Service.
5.1. The User may only use the Service for legitimate email marketing purposes.

5.4. The User must ensure that all email recipients have provided valid consent to receive emails, where required by law.
6.1. The Service is offered in various subscription forms, including a free plan with limited functionality.
6.2. Paid subscriptions are billed monthly or annually.
6.3. Prices may be changed with a notice period of 30 days.
6.4. In case of non-payment, access to the Service may be suspended.
6.5. All fees are non-refundable unless otherwise stated or required by law.
6.6. The User is responsible for any applicable taxes.
7.1. All intellectual property rights in the Service belong to the Service Provider.
7.2. The User retains all rights to content and data uploaded by them.
7.3. The User grants the Service Provider a license to process the data for the purpose of providing the Service.
7.4. The User may not copy, modify, distribute, or create derivative works based on the Service without written permission.
8.1. The Service Provider processes personal data in accordance with the Privacy Policy.
8.2. The User is the data controller for email addresses in their mailing lists.
8.3. The Service Provider acts as a data processor on behalf of the User.
8.4. The Service Provider complies with GDPR requirements and implements appropriate technical and organizational measures to protect personal data.
8.5. Data processing agreements are available upon request.
9.1. The Service Provider strives for an availability of 99.5% on an annual basis.
9.2. Scheduled maintenance will be announced in advance.
9.3. The Service Provider is not liable for interruptions caused by third parties (including Amazon AWS).
9.4. The Service Provider does not guarantee uninterrupted or error-free operation of the Service.
10.1. The total liability of the Service Provider is limited to the amount the User has paid in the past 12 months.
10.2. The Service Provider is not liable for indirect damage, consequential damage, or lost profit.
10.3. The Service Provider is not liable for damage caused by incorrect use of the Service by the User.
10.4. The Service Provider is not liable for any loss of data or content uploaded by the User.
10.5. The User is responsible for backing up their data.
11.1. The User may cancel the subscription at any time through the account settings.
11.2. Upon termination, the User retains access until the end of the paid period.
11.3. The Service Provider may suspend or terminate the account in case of violation of these terms.
11.4. After termination, the User's data will be deleted within 30 days.
11.5. The User is responsible for exporting their data before termination.
12.1. The Service Provider reserves the right to modify these terms.
12.2. Significant changes will be announced 30 days in advance by email.
12.3. Continued use after the change constitutes acceptance.
12.4. If the User does not agree with the changes, they may terminate their account.
13.1. Dutch law applies to this agreement.
13.2. Disputes will be submitted to the competent court in the Netherlands.
13.3. These terms are governed by the laws of the Netherlands, without regard to conflict of law provisions.
